POLICY 2.0: GLOBAL CONSTRAINTS

 

This is my report on your Executive Limitation policy 2.0 Global Executive Constraint, presented in accordance with your monitoring schedule. I certify the information contained in this report is true.

The Superintendent shall not cause or allow any practice, activity, decision, or organizational circumstance that is unlawful, unsafe, imprudent, or in violation of commonly accepted educational and professional ethics and practices.

Interpretation: I interpret this to mean the Superintendent shall oversee the ongoing functions in the district to ensure policies, procedures, best practices, laws, and the district’s Core Values are adhered to.

Rationale: The superintendent is responsible for the overall operations of the school district. Therefore, she/he must ensure policies, procedures, best practices, laws, and district Core Values are adhered to.

Evidence: The district website (www.orangesouthwest.org/) contains copies of all policies and procedures. The Superintendent reported all incidents of non-compliance to the Board.

Compliance: I report compliance.

Interpretation: I interpret “unlawful” to mean situations which are determined illegal by the State of Vermont, federal agencies, or courts of law.

Rationale: The provision for “lawfulness” is self-explanatory.

Evidence: The Superintendent will report all unlawful incidents to the Board. During the past year, there were no unlawful incidents.

Compliance: I report compliance.

Interpretation: I interpret “unsafe” to mean those situations which place the district in a substantial or unreasonable risk of physical, financial, or emotional harm which could have been reasonably foreseen or prevented.

Rationale: The provision for “unsafe” is self-explanatory.

Evidence: There were no reports of “unsafe” situations in the last year. In addition, the following information will be provided:

Compliance: I report compliance.

In total, over 1200 disciplinary referrals were made to school administrators between the beginning of school and the end of June. There were 114 out-of-school suspensions, 38 in-school suspensions, and 47 suspensions from receiving transportation services.

All Principals and Directors reported that fire and emergency preparedness drills, with staff and students, were completed on schedule (required monthly).

The Transportation Supervisor reported that six bus driver safety training activities were completed between the beginning of school and the end of March. Topics included harassment, bullying, confidentiality, bus evacuation, winter driving, and dealing with behavioral issues.

Interpretation: I interpret “Imprudent” to mean any situation which violates Executive Limitations or continues despite federal, state, or district mandates that require different actions.

Rationale: the term “imprudent” is self-explanatory.

Evidence: There were no reports of imprudent situations to the Board. 

Compliance: I report compliance.

Interpretation: I interpret “Commonly accepted business and professional ethics” to mean compliance with the law and normative action that affirms how things ought to be. In reference to “ethics” the principles of “truth,” “Fairness,” “Paternalism,” Nonmaleficence,” and “Beneficence” will apply. Finally, interactions and disputes will be conducted in accordance with the Boards’ Statement of Core Values.

Rationale: Healthy organizations exemplify commonly accepted business and professional ethics. By doing so, they make a statement, through their actions, about the importance of honesty and integrity within the organization and its dealing.

Evidence: There were no reports of violations of commonly accepted business and professional ethics to the Board.
